Who breaks into someone's house then sneaks up to their bedroom to use their toilet? His house is in a gated and patrolled community, surrounded by a high wall and security system. It was in no way a reasonable assumption that the person in the toilet accessible by a single door from his bedroom would be a robber that requires shooting before even confirming their identity. Especially when he had his girlfriend over who is sharing the same room as him.

The dude has no legs. Is he supposed to wait until an intruder is in the same room before defending himself? If someone is crippled and believe they are under threat then they would be stupid to not utilize any tactical advantage that increases their odds of survival.
Maybe he didn't remember she was there with him. He didn't have a lot of time to think about it. Plus, shouting out negates that thin tactical advantage I spoke of before. He definitely killed her and he was definitely negligent, but that doesn't make him a murderer.
